These Terms and Conditions apply to the use of the web-based software platform "Nexus" (hereinafter "Platform") by novofactum GmbH, Heinrich-von-Stephan-Straße 25, 79100 Freiburg (hereinafter "Provider"). By registering, the user accepts these Terms.
The Platform provides a cloud-based solution for managing forms, processes, customer data and related business processes. The scope of features depends on the chosen license plan. The Provider strives for high availability but does not guarantee uninterrupted access.
Registration is required to use the Platform. The user is obligated to provide truthful information and keep access credentials confidential. Each user is responsible for all activities under their account.
The user agrees not to misuse the Platform, not to upload illegal content, and to comply with applicable data protection regulations. The user ensures that they are authorized to process the personal data entered.
The Provider processes personal data in accordance with the GDPR and the Privacy Policy. Data is stored on servers within the European Union. The Provider takes appropriate technical and organizational measures to protect data.
The Provider is liable without limitation for intent and gross negligence. For slight negligence, the Provider is only liable for breach of essential contractual obligations, limited to foreseeable, contract-typical damages. Liability for data loss is limited to the typical recovery costs that would have occurred with regular data backup.
The agreement is concluded for an indefinite period. Either party may terminate with 30 days notice to the end of the month. The right to extraordinary termination for good cause remains unaffected. After termination, user data will be deleted within 90 days.
The Provider reserves the right to change these Terms with reasonable notice. Changes will be communicated to the user by email. If the user does not object within 30 days, the amended Terms are deemed accepted.
The laws of the Federal Republic of Germany apply. The place of jurisdiction is Freiburg im Breisgau, as far as legally permissible. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
